====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-04-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Bela P.S. Case No.193 of 2018 registered under Section 395 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. as on the basis of the fardbeyan of the informant, the present case was instituted against 8-10 unknown. In course of investigation, the police apprehended the petitioner and got recorded his confessional statement, showing his involvement and the involvement of his brother-in-law, namely, Rakesh Kumar. Later on, the police also showed the recovery of one looted
Patna High Court CR. MISC. No.23643 of 2019(2) dt.12-04-2019 2/2 mobile from the possession of Rakesh Kumar but the said mobile was not put on T.I. Parade for identification. The petitioner having no criminal antecedent is in custody since 22.01.2019.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Sadar, Sitamarhi, in connection with Bela P.S. Case No.193 of 2018. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
