JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 17-11-2016 Heard Mr. Bhola Prasad, learned counsel for the petitioners and Mrs. Veena Kumari Jaiswal, learned APP for the State.

Petitioners who are thirteen in number faced prosecution under Sections 307, 353 and 427 of the IPC as also 27 of the Arms Act vide Rupauli P.S.Case No.108 of 2016 lodged by the Block Development Officer and they pray for grant of anticipatory bail.

No.37712 of 2016 (3) dt.17-11-2016 2/2 In short, the prosecution case is that these petitioners along with others forming an unlawful assembly entered into the office and assaulted one Dev Kant Jha and thereafter also manhandled/assaulted the informant and ransacked the office. They were demanding repoll/re-election.

Having made submissions at some length and also considering the fact that some other accused persons have been released on regular bail, Mr. Prasad submits that the present application be disposed of permitting the petitioners to surrender and pray for regular bail in the light of the fact that other accused persons have been granted regular bail.

Accordingly, the application is permitted to be withdrawn enabling the petitioners to surrender before ACJM-Ist, Purnea in connection with Rupauli P.S.Case No.108 of 2016 and pray for regular bail.
