JUSTICE SHIVAJI PANDEY ORAL ORDER 20-07-2017 Heard learned counsel for the petitioners and learned counsel for the State as also counsel for the Informant. In this case, the petitioners are apprehending their arrest in connection with Uchakagoan P.S. Case No. 22 of 2017 registered for offences under sections 147, 148, 149, 341, 324, 307, 427, 435, 379, 504 and 354 of the Indian Penal Code. As per allegation, ten accused persons have entered into the private school of the Informant and started damaging the boundary and also lit on fire the roof of the school. The Informant was alone. An allegation has been made that all the persons have caught hold her hair and thrown her on the earth due to which her cloth was torn and she became half naked. When her brother-in-
Patna High Court Cr.Misc. No.22829 of 2017 (3) dt.20-07-2017 law came for rescue, he was also assaulted by other accused persons.
From the case diary, it appears that both the families have entered into scuffle and persons of both sides have received injury and have become half naked by the action of the either parties. The petitioners are ladies.
Looking to the entire facts and circumstances of the case, let the petitioners, namely, Marachho Devi, Hiramati Devi and Rajni Devi, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, IX, Gopalganj in connection with Uchakagoan P.S. Case No. 22 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Shivaji Pandey, J) Rishi/- U T
