The petitioners have prayed for regular bail in a case instituted for the offence under Sections 414/34 of the Indian Penal Code.

The allegation against the petitioners is that a stolen Bolero car has recovered from them. It is further alleged that the others co-accused used to sell the liquor by loading it in the said vehicle.

It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. They have committed no offence. Petitioners have apprehended on spot and stated that the vehicle in question belongs to co-

Patna High Court CR. MISC. No.24917 of 2023(2) dt.23-05-2023 2/2 accused Pradeep Mishra. He further submitted that there is no any complaint lodged with regard to the theft of the said vehicle. No incriminating article has recovered from the conscious possession of these petitioners. They are languishing in judicial custody since 14.02.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Gopalganj in connection with Kuchaikote P.S. Case No. 72 of 2023.
