This application for grant of anticipatory bail arises out of Jale P.S. Case No. 35 of 2016, disclosing offences under Sections 341,323,324,307,332,504,506,427,379/34 of the Indian Penal Code.
From the First Information Report, it appears that it has been alleged that the petitioner is Driver of a private bus plying on the same route on which a Government bus bearing Registration No. BR 01P-7625 operates. Allegedly, the petitioner stopped the bus in front of the Government bus and damaged it. The similar allegation is against Manoj Ram and Conductor of the vehicle. They are said to have assaulted the Driver and Conductor of Government vehicle.
Considering the nature of allegation, I am not inclined to grant the petitioner privilege of anticipatory bail. This application is, accordingly, rejected.
The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
