Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioner seeks anticipatory bail in connection with Saharsa Sadar P.S. Case No. 653/2014, registered for the offences under Sections 385, 504, 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.
The petitioner is named in the F.I.R., bearing Saharsa Sadar P.S. Case No. 653/2014, which is of 2014 and he has approached this Court for anticipatory bail in the year 2019. In the opinion of this Court, the petitioner is an absconder. When the petitioner is named in the F.I.R., then he should have approached this Court for anticipatory bail within a
Patna High Court CR. MISC. No.34555 of 2021(2) dt.31-03-2022 2/2 reasonable time. The conduct of the petitioner disentitles him for grant of privilege of anticipatory bail. This application is accordingly dismissed.
In case the petitioner surrenders in the court below within four weeks and prays for regular bail, his application for regular bail shall be considered on its own merits without being prejudiced by the fact that his anticipatory bail application has been dismissed by this Court. The Court below will also consider the fact that there is no direct allegation of assault against him.
