The petitioners are in custody in connection with Suppi P.S. Case No. 16 of 2019 for the offence under Sections 272, 273 of the Indian Penal Code and Section 30 (a) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent. He further submits that in the instant case total 81 liters liquor was seized from the tempo. Learned counsel for the petitioners next contended that the petitioners are driver and passenger of the tempo, they are not owner of the vehicle. He submits that petitioners are in

Considering the fact that the petitioners have no criminal antecedent, the Court is inclined to grant bail to the petitioners. Let, the petitioners named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned IInd Addl. Sessions Judge-cum- Special Judge, Excise, Sitamarhi in connection with Suppi P.S. Case No. 16 of 2019.
