Petitioner has already superannuated from service. It appears from the record that as on the date of swearing the affidavit petitioner was aged about 62 years whereas age of superannuation as fixed by the State Government is 60 years. As on today, petitioner has superannuated for more than five years earlier. The relief which has been sought by the petitioner cannot be granted.

Patna High Court CWJC No.12494 of 2013 (3) dt.27-09-2016 Accordingly this writ petition is dismissed.
