ANJANA MISHRA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Runnisaidpur P.S. Case No. 187 of 2016 for the offences registered under Sections 504, 341, and 323 of the Indian Penal Code and Section 3 (i) (x) of the SC/ST Act.
Learned counsel for the petitioner submits that there is only a false allegation made against the petitioner and the allegation with regard to use caste name in public place does not stand justified as there was no independent witness to the occurrence. Furthermore, the petitioner is a landless person and therefore, the allegation that the occurrence took place as the petitioner had not paid wages for having working in the khaini field of the petitioner is also false and concocted.

No.30465 of 2016 (2) dt.09-09-2016 Having regard to the facts and circumstances of the case and that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S.
