JUSTICE SATYAVRAT VERMA ORAL ORDER 14-12-2021 The learned counsel for the petitioner submits that in the cause title, inadvertently the age of the petitioner has been typed as 25 years whereas the petitioner is aged about 68 years as would be evident from his Aadhar Card. Thus, the learned counsel for the petitioner seeks permission to rectify the cause title relating to the age of the petitioner.

Permission is accorded.

Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Dumraon (Naya Bhojpur) P. S. Case No.285 of 2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 302, 506 of the Indian Penal Code and Section 27 of the Arms Act. The learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.35453 of 2021(4) dt.14-12-2021 2/2 petitioner is in custody since 04.02.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that this petitioner came to be implicated merely because he is maternal uncle of the main assailant Munna Yadav, who is stepbrother of the informant and in the F.I.R., no specific allegation except that he fired in the air has been alleged against him. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 04.02.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon (Naya Bhojpur) P. S. Case No.285 of 2020. The application stands allowed.
