JUSTICE VIKASH JAIN ORAL ORDER 09-03-2016 Learned counsel for the petitioner fairly states that in view of para-13 of the supplementary counter affidavit filed on behalf of respondent no. 2 to the effect that the Road Construction Department has withdrawn the job for supply of equipment from the BRPNN, the present writ petition has now become infructuous.

2. In view of the stand of the petitioner, the writ petition stands disposed with the observation that the petitioner shall always at liberty to represent before the concerned authorities for refund of earnest money.
