2. The petitioner is apprehending his arrest in connection with Udwant Nagar P.S. Case No. 193 of 2024 for the offence punishable under Sections 365 of the Indian Penal Code and later on added section 302, 2301 and 120(B) of the Indian Penal Code, lodged on 12.05.2024 by the informant Tejnarayan Yadav.
3. As per the prosecution story, the informant alleged that on 04.05.2024, his son went on his Swift Dzire car but disappeared thereafter. This led to the F.I.R.
4. Subsequently, during the investigation Vinay

No.23705 of 2025(4) dt.01-09-2025 2/3 Kumar Mishra and Himanshu came in the Police net and as per the confessional statement of Vinay Kumar Mishra, this petitioner requested him to provide a room as some persons are coming to see his sister. Subsequently, he found that the petitioner alongwith his brother Rohit Kumar, Rahul Rai and friend Sarvind Kumar beside unknown person came inside the room whereafter Krishna Kumar returned. Later, he came to know that due to relationship of Pooja Rai with one person, the unknown person has been killed. As he rushed to the room, found the blood stains on the walls. Though he tried to clean it, it remained and later this petitioner threatened him of dire consequences if it is informed to anyone. This has come in the paragraph no.150 of the case diary.
5. Learned counsel for the petitioner submits that only on suspicion and confessional statement, he stands implicated he had no role to play in the matter.

Learned APP on the other hand opposes the prayer submitting that a bare perusal of the confession of the one of the accused and subsequent narration of the facts by the Police points out that it is the petitioner who played the important role in the alleged act as the deceased was having relationship with his sister. Patna High Court CR. MISC. No.23705 of 2025(4) dt.01-09-2025 3/3 denied anticipatory bails.
7. Considering the submissions of the parties as also the role that has come during the course of investigation, certainly, this is not a fit case for grant of anticipatory bail.
8. Accordingly, the anticipatory bail application stands rejected.
