JUSTICE SUDHIR SINGH ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 352, 386, 504, 506 and 354/34 of the Indian Penal Code.
Allegation against the petitioner is that he along with other accused persons assaulted informant, demanded Rs.5 lacs and threatened her to withdraw the case lodged against them. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has falsely been implicated in the present case. Informant happens to be the aunt of the petitioner. There is a Title Suit pending between the parties which is evident from Annexure-2. The said Title Suit was filed prior to institution of the present case. The allegation made in the F.I.R. has been denied by the petitioner. The reason for institution of the present case is property dispute between the parties. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.27311 of 2016 (2) dt.12-07-2016 2/2 above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Begusarai, in connection with Fulwaria P.S. Case no. 33 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
