====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-02-2018 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Itarhi P.S. Case No.143 of 2017 registered under Sections 147, 148, 149, 341, 323, 326, 504, 506, 307 and 379 of the Indian Penal Code.

Learned counsel for the petitioners submits that the parties are co-villagers and have got some land dispute due to which the present occurrence has taken place. Learned counsel submits that there is false implication of the petitioners due to the land dispute.

Learned A.P.P. for the State submits that in the present case, there is specific allegation of causing knife injury in

Patna High Court Cr.Misc. No.6907 of 2018 (2) dt.17-02-2018 2/2 the abdomen of the informant and the said injury is attributed to the accused Krishna Awatar @ Mulayam Singh. So far as the accused Balram Singh @ Lalu Singh is concerned, allegation against him is that he had taken away Rs.5500/- from the pocket of the informant.

Considering the facts and circumstances, as there is specific allegation against petitioner no.2, Krishna Awatar @ Mulayam Singh, I am not inclined to grant anticipatory bail to him. However, in view of the only allegation that petitioner no.1, Balram Singh @ Lalu Singh had taken away only Rs.5500/- from the pocket of the informant, in case of his arrest/surrender before the court below within four weeks, let petitioner no.1 above named be enlarged on bail on furnishing bail bonds of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Itarhi P.S. Case No.143 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
