2. The petitioner seeks bail in Suiya P.S. Case No. 68 of 2025 (G.R. No. 2658 of 2025) dated 03.08.2025, registered under Sections 191(2), 191(3), 190, 103(1), 352, 351(2) and 3/5 of B.N.S. and Sections 302, 504, 506, 34 IPC.

3. The allegation is that 11 persons are alleged to have assaulted the informant and others.

4. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. His name transpired during investigation. In the FIR, there is specific allegation against the co-accused Jumrati and there is general and omnibus allegation against the petitioner.

5. Learned Additional Public Prosecutor for the State

Patna High Court CR. MISC. No.23819 of 2026(3) dt.18-05-2026 2/2 has vehemently opposed the prayer for bail of the petitioner.

6. Considering that the petitioner is not named in the FIR and there is general and omnibus allegation against the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate -I, Banka in connection with Suiya P.S. Case No. 68 of 2025 (G.R. No. 2658 of 2025).

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
