2. The petitioner is apprehending arrest in connection with Barhat P.S. Case No. 6 of 2024 lodged on 27.01.2024, for the offence punishable under Sections 341, 323, 325, 307, 504, 506 & 34 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against 16 named accused persons including the present petitioner. The specific allegation against the petitioner is that he has assaulted one Tripurari Thakur by tangi on his head and also broken his hand due to which injury has been caused.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that petitioner and informant are resident of the same village and on petty dispute of urinal, scuffling took place from both the sides. Counsel submits that for the same date and place of occurrence, there is case and counter case i.e. one case has

Case No.5 of 2024 and the present case has been lodged from the informant's side bearing Barhat P.S. Case No. 6 of 2024. Counsel further submits that petitioner has no criminal antecedent and co-accused persons have been granted bail by the Co-ordinate Bench of this Court vide order dated 01.10.2024 passed in Cr. Misc. No.65494 of 2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner but submits that petitioner has no criminal antecedent.

6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in connection with Barhat P.S. Case No. 6 of 2024, subject to the conditions as laid down under Section 438(2) Cr.P.C.
