JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-09-2017 At the outset, it is submitted by the learned counsel for the petitioners that during pendency of the present application, the petitioner no.1, namely Padarath Singh @ Padaras Singh has already been arrested by the police.

In that view of the matter, his application for grant of pre-arrest bail has become infructuous and, as such, the same is dismissed as infructuous.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with

Patna High Court Cr.Misc. No.41458 of 2017 (2) dt.19-09-2017 2/2 Narhat P.S. Case No.93 of 2017 registered under Sections 147, 149, 341, 323, 307 and 504 of the Indian Penal Code. Considering the fact that in the first information report the specific allegation of causing injury on the head of the informant with Kudal is against petitioner no.1, namely, Padarath Singh @ Padaras Singh and the allegations, so far as other petitioners are concerned, are general and ombibus in nature, the petitioners, namely, Rajo Singh, Binod Singh, Mantun Singh, Gopal Singh @ Gopal Kumar and Chunnu Singh are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Nawada in connection with Narhat P.S. Case No.93 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within four weeks from today.
