This application for anticipatory bail arises out of Triveniganj P.S. Case No. 4 of 2019 for the offence punishable under Sections 420, 465, 467 and 471 of the Indian Penal Code. The petitioner is said to have been appointed as Aangabadi Sevika in Primary School Laharnia at Mirjava Panchayat in the district of Supaul. Her testimonials were sent for verification after her appointment. It has been found, however, that the documents, she had relied for seeking her appointment, were forged.
Learned Senior Counsel, appearing on behalf of the petitioner, while denying the allegation made in the First Information Report, has submitted that case of the prosecution is based on the documents and, therefore, there is no chance of tampering with the evidence or influencing the witnesses. He
Patna High Court CR. MISC. No.22110 of 2019(2) dt.09-04-2019 2/2 has also submitted that the petitioner has already resigned from the post on 07.08.2018 itself.
Considering the above and the fact that the petitioner is a lady, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Supaul, in Triveniganj P.S. Case No. 4 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
