JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 120B and 34 of the Indian Penal Code read with Section 30(d) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 26.03.2022, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 100 litres of spirit from the house of Ramesh Sah (petitioner).

Learned counsel for the petitioner submits that the petitioner was not arrested from the spot rather came to be implicated based on disclosure made by the local chowkidar

Patna High Court CR. MISC. No.24517 of 2022(2) dt.20-05-2022 2/2 with whom he was on an inimical term and the house is a joint family property and as such was not knowing who had kept the liquor in the house.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 26.03.2022, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Hiramma P.S. Case No. 33 of 2022.
