This application has been filed for modification of the order dated 18.04.2016 passed in Cr. Misc. No.47270/2015 by this Court as the petitioner could not surrender within six weeks and deposit Rs.25,000/-.

It is contended that now he is ready to deposit Rs.40,000/- at the time of surrender and, thereafter, Rs.15,000/-per month in four installments.

There is no opposition to the prayer made on behalf of the petitioner.

Accordingly, by way of last indulgence, the period granted for surrender in connection with C.A. Case No.1824 of

Patna High Court Cr.Misc. No.27567 of 2016 (2) dt.14-07-2016 2/2 2011 pending in the court of Sri G.K. Yadav, Judicial Magistrate, Purnia is extended by four weeks from today.

However, it is made clear that at the time of furnishing bail bond, the petitioner would be required to deposit Rs.40,000/- and, thereafter, Rs.15,000/-per month in four installments.

It is further made clear that if the petitioner after payment of initial amount of Rs.40,000/- fails to deposit the subsequent amount, the court below would proceed to cancel his bail bond.

Accordingly, the order dated 18.04.2016 passed in Cr. Misc. No.47270/2015 stands modified to the aforesaid extent. (Dr. Ravi Ranjan, J) V.K. Pandey/- U T
