3. The grievance of the petitioner in the present writ petition is that notwithstanding the higher merit position, the petitioner has been wrongly shown to have

Patna High Court CWJC No.9031 of 2020 dt.28-06-2021 2/3 only entitled to award of marks of 67.01, however, during counselling, it was enhanced to 71.35 marks and if 71.35 marks is taken into consideration, the petitioner would be very much within the zone of consideration as many persons having lesser marks than the petitioner have been considered and offered appointment.

Considering the aforesaid, the writ petition is disposed off with a direction to the respondents to verify the records and if it is found that persons having lesser marks have been considered and offered appointment, the petitioner shall also be considered and offered appointment against the vacant post. In case vacant post is not available, the respondents will make room for appointment of the petitioner as per merit position by ousting below in merit list. The entire exercise in this regard shall be completed by the respondents within a maximum period of four months from the date of receipt/production of a copy of this order.
