2. The petitioner apprehends his arrest in connection with K. Nagar (Sri Nagar) P.S. Case No. 39 of 2024 registered under Section 505 of the Indian Penal Code and Section 66 of the I.T. Act, 2000.
3. It is alleged that petitioner sent hateful messages from his Instagram ID which hurt religious sentiments.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further submission is that petitioner has not transmitted the alleged message through his Instagram ID. On the date of occurrence, the petitioner was in the house of co-accused Md. Sannower and his mobile phone
Patna High Court CR. MISC. No.28251 of 2024(2) dt.14-05-2024 2/2 was in the hand of co-accused Md. Sannower and it might be possible that Md. Sannower might have transmitted the alleged message by using Instagram ID of the petitioner but when it came to the knowledge of the petitioner, he immediately deleted the said message. Petitioner is a young man of 20 years and has got no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Purnea in connection with K. Nagar (Sri Nagar) P.S. Case No. 39 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
