JUSTICE RAKESH KUMAR ORAL ORDER 01-09-2016 Heard Sri Sunil Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Nauhatta P.S. Case No.12/2016 registered for the offence under Sections 304/34 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest.

By way of referring to F.I.R. learned counsel for the petitioner submits that it was alleged that the husband of the informant got electrocuted due to laches on the part of the petitioner and others since naked wire was lying in the field. He submits that save and except the aforesaid allegation, there is no material to connect that to the knowledge of the petitioner such electric line was lying on the ground. He submits that the

No.34441 of 2016 (2) dt.01-09-2016 2/2 petitioner is residing outside the State since long i.e. more than 10 years for earning his livelihood, I have perused the materials on record including the F.I.R. After going through the same, particularly the F.I.R., the Court is satisfied that it is a fit case for extending the privilege of anticipatory bail. Accordingly, let the petitioner, namely, Shiv Ram, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri, Rohtas in connection with Nauhatta P.S. Case No.12/2016., subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
