JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 325, 354 and 504/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act. The accusation is of assaulting the informant, trying to outrage the modesty and when the mother of the informant went to rescue, she was also assaulted and abused by calling caste name. It is submitted by learned counsel for the petitioners that there is counter version of the occurrence also and the injury of the informant has been found to be simple in nature. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

The aforesaid facts constitute good ground for

Patna High Court Cr.Misc. No.51891 of 2015 (2) dt.10-11-2015 2/2 consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Basopatti P.S. Case No. 36 of 2015 pending in the court of learned JM, 1st Class, Madhubani. Accordingly, the application is disposed of.
