JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner and the respondents.

By filing interlocutory application bearing I.A. No.6980 of 2015, the petitioner has challenged the impugned order dated 23.10.2012, by which his P.D.S. license has been suspended on the ground of pendency of a criminal case.

After amendment coming into force on 23.06.2011, the power to cancel the P.D.S. license during the pendency of a criminal case has been deleted. As such, the impugned order dated 23.10.2012, suspending the P.D.S. license of the petitioner, is set aside.

This application stands allowed.
