JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 The petitioner seeks regular bail in connection with Rajgir P.S. Case No. 33 of 2019, registered for offences punishable under Sections 364/120(B) of the Indian Penal Code. F.I.R. disclosed the allegation that the son of the informant was called by co-accused Sajan Kumar and Deo Raj alias Hari went to the house of informant and took his son Bikash Kumar on the pretext of getting CCTV/camera fixed, thereafter, the son of informant did not return and during investigation, it has come that son of informant died. It has been submitted on behalf of the petitioner that he is not named in the F.I.R. and save and except confessional statement of co-accused, there is absolutely nothing against the petitioner and further the confessional statement is only to the effect that petitioner has provided fooding to said Sajan Kumar

Patna High Court CR. MISC. No.24234 of 2019(3) dt.21-05-2019 2/2 and other co-accused and he has been in judicial custody since 01.02.2019 and now chargesheet has also been submitted. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Biharsharif, in connection with Rajgir P.S. Case No. 33 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
