====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2016 Heard learned counsels for the petitioner and the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under sections 272 and 273 of the Indian Penal Code and sections 47 and 53B of the Bihar Excise (Amendment) Act, 2016.

The prosecution case is that on information, raid was laid in the house of co accused Sudama Gore when some persons were found consuming liquor behind the house of the petitioner but they managed to escape leaving empty liquor bottles. Thereafter, the house of the petitioner was raided. From the house of the petitioner 25 bottles of liquor were recovered each containing 200 ml.

No.35930 of 2016 (2) dt.07-09-2016 2/2 It is submitted by the learned counsel for the petitioner that the petitioner is an old lady and maliciously she has been roped in the present case. It is further submitted that the recovery, if any, has been made from the joint family house. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the nature of accusation and the petitioner being lady having no criminal antecedent, it is a case for consideration of the prayer for bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Mairwa P.S. Case No. 50 of 2016 pending in the court of learned ACJM III, Siwan.

This application is disposed of with the aforesaid observation/direction.
