The Petitioner submits that the trial is still pending and hence he presses the prayer for setting aside the order dated 6.8.2012 passed by the Additional Sessions Judge 1st, Bhojpur at Ara in S.T. No.324 of 2004 arising out of Barhara P.S. case No.30 of 2000, by which he has refused an application under Section 311 Cr.P.C. Considering that after repeated opportunities the doctor and the Investigating Officer were not produced by the prosecution, I see no merit in the application. The same is dismissed.
