ANJANA MISHRA ORAL ORDER 22-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner being father in law is apprehending his arrest in connection with G.R. Case No. 2679 of 2015 arising out of K. Nagar P.S. Case No. 292 of 2015, registered for offences punishable under Section 304(B) of the Indian Penal Code. Diary in the present case was called for which has since been received.
Learned counsel for the petitioner submits that though there is an alleged demand of dowry, the present petitioner has nothing to do with the allegations as made out in the F.I.R as he was living separately from his son. He further submits that the petitioner being an old man, may be extended the privilege of anticipatory bail as there is only general and omnibus allegation
Patna High Court Cr.Misc. No.50073 of 2015 (4) dt.22-01-2016 2/2 has been made against him.
Considering the aforementioned facts and circumstances and the nature of allegations as made out and there being no further cogent material in the case diary, let the petitioner above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Purnea in connection with G.R. Case No. 2679 of 2015 arising out of K. Nagar P.S. Case No. 292 of subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
