The petitioner apprehends his arrest in Sohsarai P.S. Case No.31 of 2019 registered under Sections 366A and 34 of the Indian Penal Code.

The informant alleged that the petitioner with the help of his parents kidnapped his minor daughter.

Learned counsel for the petitioner submits that the victim denied the factum of her kidnapping. She disclosed in her statement made under Section 164 of the Cr.P.C. that she voluntarily left her house and went to Biharsharif and Patna. Again she returned to her house. Nobody kidnapped her. Having considered the facts that the victim herself denied the factum of her kidnapping, the above named petitioner, in the event of his arrest or surrender before the

Case No.31 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
