The petitioner apprehends his arrest in Khiri More P.S. Case No. 3 of 2016 registered under Sections 143, 384, 387 and 435 of the Indian Penal Code and Section 27 of the Arms Act. The informant made allegation that the petitioner and others came to his site and set ablaze mixture machines only due to non-fulfillment of extortion. Learned counsel for the petitioner submits that the petitioner is also a contractor and both the informant and the petitioner are at daggers drawn. This false case has been lodged due to signing of contract but it appears that the petitioner has got criminal antecedents and as many as seven criminal cases are pending against the petitioner. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Khiri More P.S. Case

Patna High Court Cr.Misc. No.30109 of 2016 (2) dt.08-09-2016 2/2 No. 3 of 2016. Accordingly, the same is rejected. If the petitioner surrenders in the court below, the court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced from this order.
