2. The petitioner seeks regular bail in connection with Sahebganj P.S. Case No. 539 of 2024 registered for the offence(s) punishable under Sections 313, 109,317(5), 3(5) of the B.N.S. and Sections 25(1-B)a, 26, 27, 35 of the Arms Act.
3. As per prosecution case, two live cartridges were recovered from the conscious possession of the petitioner.
4. Learned counsel for the petitioner submits petitioner is quite innocent and has falsely been implicated in this case by the police merely on suspicion. He further submits that petitioner is neither owner nor driver of the seized vehicle. He further submits that co-accused have already granted bail by
Patna High Court CR. MISC. No.24170 of 2025(2) dt.02-05-2025 2/2 the Co-ordinate Bench of this Court in Cr. Misc. No. 20045 of 2025 vide order dated 25.04.2025. He further submits that petitioner has got no criminal antecedent and he is in custody since 24.10.2024.
5. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
6. Considering all aspects of the case, materials available on records, submissions made by the learned counsel for the petitioner and co-accused have already granted bail by the Co-ordinate Bench of this Court in Cr. Misc. No. 20045 of 2025 vide order dated 25.04.2025. Accordingly, let the petitioner named-above be enlarged on bail in connection with Sahebganj P.S. Case No. 539 of 2024 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C Court No. 4 (West) Muzaffarpur.
