Heard learned counsel for the petitioner and learned Additional Public Prosecutor (for brevity, APP) appearing for the State of Bihar.
The petitioner has preferred this application for grant of regular bail in connection with Shastrinagar Police Station (for brevity, PS) Case No 210 of 2021 dated 13.06.2021 registered for the offence punishable under Sections 406, 409, 420, 504, 506, 120B of Indian Penal Code.
As per prosecution case, on the assurance of coaccused Chandan Pandey, the informant paid Rs 32 lakhs in the
Patna High Court CR. MISC. No.25983 of 2023(2) dt.23-05-2023 2/3 account of Bhu Samriddhi Private Limited Company for getting 2,400 Square Feet of land registered in her favour. It is further alleged that the co-accused Chandan Pandey has stated that he is the owner of the said land. Despite taking the said consideration amount, the co-accused persons denied to execute the said sale deed and also threatened her. The co-accused Chandan Pandey had returned Rs 3.490 lakhs to the informant. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The co-accused Chandan Pandey has already returned Rs 3.40 lakhs to the informant.
It is further submitted that the petitioner resigned from the said Finance Company on 08.02.2021. Thereafter, the present case has been filed against him on 13.06.2021. He is not named in the First Information Report. The petitioner has clean antecedent, as stated in paragraph 3 of the bail petition. He is in custody in this case since 15.01.2023. Co-accused Ramesh Kumar has been granted bail by a co-ordinate Bench of this Court by order dated 11.04.2022 passed in Cr Misc No 8597 of 2022. Another coaccused Alok Kumar has also been granted bail by this Bench by order dated 13.12.2022 passed in Cr Misc No 50863 of 2022.
Patna High Court CR. MISC. No.25983 of 2023(2) dt.23-05-2023 3/3 Learned APP has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Patna in Shastri Nagar PS Case No 210 of 2021 dated 13.06.2021.
This application stands allowed.
