The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 420, 406, 341, 323/34 of the Indian Penal Code.

The prosecution case is that under conspiracy the petitioners took rupees one lacs for providing employment to the informant's son but neither the employment being provided nor the alleged amount was being returned.

It is submitted by learned counsel for the petitioners that there is no proof with regard to the payment. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named

Patna High Court Cr.Misc. No.53401 of 2015 (2) dt.24-11-2015 2/2 petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM, Benipur (Darbhanga) in connection with Bahera P.S. Case No.380 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
