JUSTICE SUDHIR SINGH ORAL ORDER 15-07-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 147, 149, 341, 342, 323, 302 of the Indian Penal Code. The prosecution case, in short, is that the petitioner having closed the nose and mouth of the husband of the informant, thrashed him and thereafter co-accused Md. Anamul sat on his chest and pressed his neck. Other accused persons brutally assaulted him and in consequence thereof, her husband died on the spot.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.2.2019. Charge sheet has been

Patna High Court CR. MISC. No.23068 of 2019(4) dt.15-07-2019 2/2 submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. No specific injury is attributed against the petitioner. The main allegation is against co-accused Md. Anamul, who is said to have pressed the neck of the deceased. As per the postmortem report, the cause of death is due to throttling.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. case No.332 of 2018.
