This application, for grant of anticipatory bail, arises out of Mohania P.S. Case No. 416/2017, disclosing offences under Sections 418, 419, 420, 384, 34 of the Indian Penal Code. Manoj Kumar Singh, co-accused was arrested by the police on the allegation that he used to facilitate crossing of overloaded trucks from Bihar to U.P. on the Bihar-U.P. Border. He is said to have saved several vehicles numbers in his cell phone that was suggestive of his involvement in such activity, with the aid of active associates and support of other 16 persons including the petitioners.
Patna High Court Cr.Misc. No.43048 of 2017 (2) dt.20-09-2017 2/2 Learned counsel appearing on behalf of the petitioners is correct in his submission that over and above the said allegation against the petitioner, there is nothing against him in the F.I.R.
Considering the facts aforesaid, this application is allowed. Let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S. Case No. 416/2017, subject to the condition laid down under Section 438(2) of the Cr.P.C.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
