The petitioners have prayed for bail in a case instituted for the offence under Sections 461 and 379 of the Indian Penal Code.

AS per allegation in the FIR, some unknown persons has stolen 14 liters gas cylinder from the kiosk shop of the informant after breaking the lock.

It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. They are not named in the FIR. They have committed no offence.

Patna High Court CR. MISC. No.26601 of 2023(2) dt.23-05-2023 2/2 Only on the basis of disclosure made by the police spy, their names have been dragged in the present case. The stolen gas cylinder has been recovered from the maternal uncle of petitioner no. 3. Petitioners has got no criminal antecedent and are languishing in judicial custody since 23.01.2023. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Siwan in connection with Aandar (M.H. Nagar) P.S. Case No. 17 of 2023.
