The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 511, 419, 468, 471 of the Indian Penal Code and Section 66(D) fo the I.T. Act.

As per prosecution case, on 29.8.2022 the informant reached near Gewal Bigha more where he received audio clips and found that the said clip is of petitioner who demanded Rs. 5-6 thousand from the victim of Rampur P.S. Case No. 81 of 2022 hence, the present FIR has been lodged.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted vide

Patna High Court CR. MISC. No.25115 of 2023(2) dt.23-05-2023 2/2 para 7 of the petition that Muffasil P.S. Case no. 81 of 2022 which is alleged to be related to one Abhishek as a victim but from perusal of said case it appears that the Abhishek is not related with the said case rather one Champa Devi is informant of the said case. The informant made false and fabricated story and implicated the petitioner. It is further submitted that the petitioner has not concern with the alleged offence and languishing in judicial custody since 10.12.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rampur P.S. Case No. 455 of 2022 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Gaya.
