The petitioner apprehends his arrest in connection with Singhwara P.S. Case No. 197 of 2015, registered under Sections 147, 148, 149, 448, 341, 323, 307, 427, 380, 504 and 506 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Darbhanga.
The accusation is that eight persons named in the F.I.R, including the petitioner, came to the informant variously armed with weapon and started assaulting him, when Meraj Ahmad came to rescue the informant, then the petitioner Md. Molu caused injury at his neck and below eyes through sword. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this
Patna High Court Cr.Misc. No.35124 of 2016 (2) dt.02-09-2016 2/2 case due to grudge and enmity.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within six weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
