JUSTICE ARVIND SRIVASTAVA ORAL ORDER 15-09-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Nursarai Police Station Case No. 81 of 2017, disclosing offences under Sections 341, 323, 308, 354, 313, 506, 504, 324 and 34of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioners has submitted that there is land dispute between the parties on account of land dispute, altercation took place and a case and counter has been
Patna High Court Cr.Misc. No.34732 of 2017 (3) dt.15-09-2017 lodged by both the parties as both of them have sustained injuries. Nothing has been recovered from the conscious possession of the petitioners. Hence, the petitioners, who are said to be of clean antecedents, deserve the privilege of anticipatory bail.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bihar Sharif, Nalanda, in connection with Nursarai Police Station Case No. 81 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
