2. The petitioner is apprehending his arrest in Complaint Case No. 1927 of 2024 (T.R. Case No. 2002 of 2025) registered under Section-85 of the Bhartiya Nyaya Sanhita.

3. As per prosecution case, the complainant was married with the petitioner as per Hindu rites and rituals. It is further alleged that after marriage, the accused persons started demanding a car and a sum of

Patna High Court CR. MISC. No.24322 of 2025(4) dt.08-10-2025 2/3 Rs. Ten lakhs as dowry and due to non-fulfillment of the same, the complainant was tortured, assaulted and ultimately, she was left at her matrimonial house.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. He is the only son of his parents and the behaviour of the complainant was cruel with her in-laws and it is the reason that the petitioner has already filed a suit for divorce. After filing of that divorce case, the present case has been filed in retaliation. He has further submitted that the petitioner is continuously paying Rs. 15,500/- per month to the complainant in compliance of order dated 19-06-2024 by Air Chief Martial.

5. On the otherhand, learned counsel for the complainant has submitted that the petitioner inflicted cruelty on the complainant for nonfulfillment of demand of dowry.

6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court

No.24322 of 2025(4) dt.08-10-2025 3/3 below within a period of four weeks, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Samastipur in connection with Complaint Case No. 1927 of 2024 (T.R. Case No. 2002 of 2025), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
