Petitioners apprehend their arrest in Bakhtiyarpur P.S. Case No.549 of 2018, registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The informant, a police officer, got information that Jay Prakash Singh and his wife, the petitioners, are illegally dealing in illicit liquor from the poultry farm of Awadhesh Singh, Sablu Singh and Munna Singh. On such raid was conducted and some bottles of Indian made foreign liquor were recovered.

Learned counsel for the petitioners submits that of course the informant named the petitioners on secret

Patna High Court CR. MISC. No.23540 of 2019(2) dt.11-04-2019 2/2 information that the petitioners were illegally dealing in illicit liquor but there is no material on record to show that the petitioners had kept liquor in the poultry farm of Awadhesh Singh. The recovery was made from the poultry farm. Petitioners have got no manner of concern and they have falsely been dragged in the case.

Having considered the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, District Patna in connection with Bakhtiyarpur P.S. Case No.549 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
