2. The petitioner seeks bail in connection with Darbhanga Sadar P.S. Case No. 764 of 2023 instituted for the offences under Sections 341, 323, 307, 325, 379 and 506/34 of the Indian Penal Code.

3. The allegation against the petitioner along with others is of assaulting the informant due to which the informant sustained injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The only allegation against the petitioner is that he assaulted the informant by means of phatta. From perusal of the

Patna High Court CR. MISC. No.28988 of 2024(2) dt.20-04-2024 2/2 Injury report, the doctor opined that the informant sustained injury on non-vital part and the injury is simple in nature. Charge-sheet has been submitted in this case. The petitioner is in custody since 01.03.2024 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case as well as the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Darbhanga Sadar P.S. Case No. 764 of 2023.
