The intervention application is disposed of with a liberty to the intervenors to file a fresh writ application for redressal of their grievances.

Heard the parties.

The prayer of the petitioners is that they do not dispute with regard the acquisition of 4.362 acres of land which has been mentioned in the counter affidavit of the Staterespondents. Their prayer is that the extra land which is under the possession of the State may be demarcated so that the petitioners can peacefully enjoy the possession of the remaining portion of the land in question.

Learned counsel for the State has no objection with regard to the same. The State will fix a firm date for measurement of the land.

The Collector, Samastipur will get a firm date fixed for measurement and the petitioner shall also be informed about the date for measurement and on that date, the State will demarcate the acquired land for the State so that this dispute is finally settled between the petitioners and the State within a period of four weeks from today.
