The petitioner apprehends his arrest in connection with Govindpur P.S. Case no. 14 of 2016, registered under Sections 272, 273 of the Indian Penal Code and Section 47(a) of the Excise Act. The accusation is that on receiving secret information about selling of illicit liquor by this petitioner in village Darshan, the Police reached near bridge of village Darshan then several persons started fleeing from there, but six persons, namely, Manoj Yadav, son of Late Biru Yadav, Arbind Yadav, Awadh Yadav, Rajendra Yadav, Krishna Yadav and Jawahir Yadav were apprehended by the Police and 1/2 litre liquor was found with them. The apprehended persons disclosed that they had purchased the said liquor from this petitioner and near bridge 25 Litre illicit liquor in two containers was seized. Learned counsel for the petitioner submits that it would
Patna High Court Cr.Misc. No.36610 of 2016 (2) dt.16-09-2016 2/2 appear from the F.I.R. that petitioner was not apprehended by the Police with illicit liquor. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Govindpur P.S. Case No. 14 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
