ANJANA PRAKASH ORAL ORDER 02-09-2015 Heard learned counsel for the Petitioner and the State. The Petitioner seeks quashing of the order dated 17.7.2012 by which the Adhoc Additional Sessions Judge, Banka, has summoned him to face Trial under the Provisions of Section 319 Cr. P.C. in Sessions Trial No. 765 of 2004. Considering that the Petitioner is named in the First Information Report, I see no justification for entertaining this petition any longer.
The application stands rejected.
The Trial Court is directed to conclude the Trial expeditiously without granting unnecessary adjournment to any Party for which reason, he is directed to send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order in connection with Sessions Trial No. 765 of 2004 arising out of Amarpur P.S. Case No. 163 of
Patna High Court Cr.Misc. No.45135 of 2012 (5) dt.02-09-2015 2/2 2002, to the Superintendent of Police, Banka, and the Superintendent of Police, Banka, is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
