====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 19-06-2025 Heard Mrs. Nutan Sahay, learned counsel for the Veer Kunwar Singh University (henceforth for short 'the University').
2.The present petition has been preferred for the following relief/s:
(i) against the order dated 10.12.2019 passed in CWJC No. 24616 of 2019 by Hon'ble Mr. Justice Prabhat Kumar Jha (as his Lordship then was) whereby
Patna High Court C. REV. No.86 of 2020(6) dt.19-06-2025 2/3 it was observed that Maharaja Law College, Ara is affiliated unit of Veer Kunwar Singh University, Ara and direction was given to issue original certificate of L.L.B to the Petitioner within 4 months from the date of the receipt of this order.
3. Learned counsel representing 'the University' submits that the Maharaja Law College, Ara is not regularly affiliated with the Veer Kunwar Singh University, Ara inasmuch as for want of infrastructure, at times, the Bar Council of India de-list the aforesaid college from affiliation and due to this off and on, 'the University' also advertised that those taking admission shall be doing so at their own risk.
4. The point raised by the learned counsel is limited. Though 'the University' has issued the certificate to original writ petitioner, Mamta Kumari, a copy of the same has also been provided to this Court which shows that she has received it on 20.09.2021, 'the University' is aggrieved by the fact that in the writ court order dated 10.12.2019, the word affiliated has come.
5. In support of the claim, she has produced press release of the Registrar of 'the University' to show that in the
Patna High Court C. REV. No.86 of 2020(6) dt.19-06-2025 3/3 year 2019-21, it was not affiliated.
6. To another query whether at the time, Mamta Kumari took admission, it was affiliated, the answer is in affirmative.
7. In the opinion of this Court, the said word in no way affects the health of 'the University'. If the college is not affiliated for a particular session and the same has been informed by way of press note, those taking admission at their own risk, have to face the music.
8. The writ Court has taken note of the particular line recording that it is affiliated with 'the University', Ara . The same be read as when the writ petitioner took admission, it was affiliated. The order dated 10.12.2019 passed by the writ Court is modified to that extent.
9. This order has been passed in the particular facts and circumstance of the case of the writ petitioner, Mamta Kumari and cannot have universal application in the case of other individuals.
10. The review petition stands disposed of.
