The present application has been filed for modification of the order dated 09/03/2017, passed in Criminal Miscellaneous No.37313/2016, for extending the period of surrender.
The petitioner being the husband of the informant was granted provisional anticipatory bail for five months in a case registered for the offences punishable under Sections 498A/34 of the I.P.C. and Sections 3/4 of the Dowry Prohibition Act. The issue between the petitioner and the informant got reconciled through the process of mediation, where they agreed to part ways on payment of one time settlement amount of Rs.3,00,000/-. Out of which Rs.50,000/- was paid to the informant
Patna High Court Cr.Misc. No.30002 of 2017 (2) dt.05-07-2017 2/2 through two bank drafts while rest Rs.2,50,000/- was to be deposited before the learned Court below before the confirmation of provisional bail.
It is submitted by learned counsel for the petitioner that the draft of Rs.2,50,000/- has already been submitted before the learned Court below, but the petitioner could not surrender in time, hence, period of surrender may be extended. Considering the submission made by learned counsel for the petitioner, let the date of surrender be extended by three weeks calculated from the date of receipt or production of copy of the order. However, the present order will be subject to the verification by the learned Court below with regard to submission of draft of Rs.2,50,000/- The order dated 09/03/2017 stands modified to the extent indicated above.
Accordingly, the modification application is disposed of in connection with Siwan Town (Nagar) P.S. Case No.363 of 2016, pending before learned Chief Judicial Magistrate, Siwan.
