Learned counsel for the petitioners submits that the order passed by the Court is erroneous. There is no injury on the cousin brother of informant namely Shankar Thakur. I have considered the submissions, find that the learned Additional Sessions Judge-III, Danapur, Patna, while recording the bail application has also mentioned that Bhushan Thakur along with Ravi Thakur, Dev Thakur and Anish Thakur brutally assaulted the informant and his brother, causing injury on the temple.

Keeping in view said observations, no case for grant of second anticipatory bail is made out under Section 438 of the

Patna High Court CR. MISC. No.25744 of 2022(3) dt.13-07-2022 2/2 Cr.P.C.

The same is accordingly dismissed.
