Three petitioners, apprehending their arrest in Harlakhi P.S. Case No.121/15 registered for the offence under Sections 341, 323, 354, 504/34 of the Indian Penal Code and Section 3(1)(x) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act ( hereinafter referred to as the "SC/ST Act"), have prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioners that there was case and counter case in between the parties and petitioners have falsely been implicated in the present
Patna High Court Cr.Misc. No.31887 of 2016 (2) dt.29-08-2016 2/2 case. However, learned Addl. Public Prosecutor, by way of referring to the fact disclosed in the F.I.R., submits that in this case, there is accusation of Section 3(1) (x) of SC/ST Act and as per Section 18 of SC/ST Act, the petition for anticipatory bail may not be entertained.
I do not find any ground to entertain the present petition. The petition stands disposed of.
